User Agreement

This agreement pertains to any services provided by Rackrs.com. Please read the rules contained in this agreement carefully. If you cannot agree to the terms and conditions in the User Agreement do not use or access our site or services. These rules may be modified from time to time; the date of the most recent revisions will appear on this site. Rackrs.com, allows individuals to list, trade and sell their goods and services. Rackrs.com also allows members to add information to the site (autograph guide, signing events, through the mail, comments, blogs).

  1. Registration and Membership - The Service is not intended for users under the age of 13, and Rackrs.com, does not knowingly collect personal information from users under the age of 13. Information submitted by such users will not knowingly be used, posted, or retained by Rackrs.com, If you are a under the age of 13, you may use our site, but only under the supervision of your parents or legal guardian. We reserve the right to refuse service, terminate accounts, remove or edit content in our sole discretion.   2. Fees and Services - It is free to register on Rackrs.com. If you intend to sell or trade tangible items (goods) and intangible items (services) on Rackrs.com, a low fee of $4.99/month will be charged - all other services are free. Rackrs.com may change fee policies at any time. Any changes to the policy will be posted on Rackrs.com, and will take effect within seven (7) days after notice is given on the site. As a registered user, you are wholly responsible for paying all applicable fees associated with using the services the site, and paying all applicable taxes associated with income received. The seller or trader shall file all sales tax returns in accordance with applicable law, and each seller shall indemnify All Star Trades, LLC, against any tax related to the sale of such seller's goods or services. Seller is responsible to for charging sales tax to a buyer that resides in the same state as the seller.
  3. Rackrs.com is a Venue - Rackrs.com, is only a venue for members (sellers/traders) to list their goods and services and for buyers to purchase or trade such items. We do not transfer legal ownership of items from the seller to the buyer or trader to tradee. Rackrs.com, is not involved in the transaction between the buyer and the seller or trader and tradee, we just make it possible for these individuals to find each other. Rackrs.com, has no control over any listing or information that might be shared on the site. We also have no control over the truth or accuracy of the listings, services or information that is advertised and/or provided. Rackrs.com, is also not responsible for the seller's capability in selling or trading items or services as well as the capability of a buyer to pay or trade for that item or service.
  4. Bidding and Buying Goods - If you buy, sell or trade goods or services on Rackrs.com, you enter into a legally binding contract with that buyer, seller or trader, and you are obligated to complete the transaction. You and the seller or trader may agree to not complete the transaction, but if there is no agreement you will become the good's lawful owner upon physical delivery of the goods to the buyer. Bids are retractable only if (1) there is a clear error made in the listing, (2) buyer, seller or trader mutually agree to cancel, (3) seller or trader significantly changes the item's description after the buyer has bid on the item, and/or (4) they buyer or trader cannot authenticate the seller or traders identity. You must be legally able to sell or trade the goods or services that you list for sale on Rackrs.com. Sellers or Traders must describe their goods and services fully, and all terms of sale or trade, including shipping and if there are any applicable taxes.
  5. Using Services of Registered Users - If you use any of the services that are provided by registered users on Rackrs.com, we are not responsible for any disputes that might arise between you and the service provider. Rackrs.com, is a venue, and if you have a dispute with one or more users, you release Rackrs Media, LLC, (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
  6. Fraud in Connection with Rackrs.com - Rackrs.com, may suspend or terminate your account if we suspect that you have engaged in any form of fraudulent activity in connection with the use of the site. Buyers, sellers and traders on Rackrs.com are prohibited from misuse of the bidding, selling or trading process. You may not have other members bid on items for the purpose of raising the bid price. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead in any form. Rackrs.com, reserves the right to remove or edit such content. Rackrs.com, takes no responsibility and assumes no liability for any content posted by you or any third party. Registered users of Rackrs.com are also prohibited from: (1) Providing false or misleading information about themselves or the products or services being sold, traded or solicited, (2) selling stolen or counterfeit goods, (3) using obscene media (photos, video, audio, etc.), (3) violating any laws in the United States or Internationally, (4) threatening or harassing other members; and (5) distributing any materials with any form of viruses, trojan horses, worms or any performance that will cause harm to other users.
  7. Warranty - THE CONTENT, CODE, ACCESS, AND OTHER FEATURES OF THIS SITE ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND/OR NON-INFRINGEMENT. Arbitration is a form of Alternative Dispute Resolution (ADR) in which parties choose an impartial third party to hear and decide the dispute. This arbitration hearing will be held in Bexar County, Texas or another location mutually agreed upon by the parties.

Copyrights, Trademarks and Patents - All content included on Rackrs.com, such as text (ex. signing events, ttm autographs and addresses), graphics, logos, button icons, images (ex. autograph reference guide), audio clips, digital downloads, data compilations, videos and software, is the property of Rackrs.com or its content suppliers and are protected by United States and international copyright laws. Any violations or misuse will be meet with monetary damages. Any copyrights associated with Rackrs.com may not be used by anyone other than Rackrs.com unless you have express written consent from Rackrs Media, LLC.
